These Terms of Service (“Terms”) govern your use of the Viewpulse service (“Service”) provided by Vector Mesa LLC (“Company”) at useviewpulse.com. By using Viewpulse, you agree to these Terms.
1. Description of Service
Viewpulse is a social media analytics monitoring service that automatically collects daily performance metrics (views, likes, comments, shares) from your connected TikTok, Instagram, and YouTube accounts and presents them in a unified dashboard.
2. Account Registration
To use Viewpulse, you must create an account with a valid email address. You are responsible for maintaining the security of your account credentials. You must be at least 16 years old to use this service.
3. Authorized Use
You may use Viewpulse only for accounts that you own or have explicit authorization to monitor. You may not use Viewpulse to collect metrics from accounts belonging to others without their consent.
4. Platform Terms Compliance
By connecting your social media accounts, you confirm that you comply with the terms of service of those platforms:
Viewpulse uses the official APIs provided by these platforms. We adhere to their developer policies and data usage requirements.
5. Data and Privacy
Our collection and use of your personal information is governed by our Privacy Policy. By using Viewpulse, you consent to the collection and use of information as described therein.
6. Service Availability
We aim to provide reliable service but cannot guarantee 100% uptime. Metric collection may be delayed or temporarily unavailable due to platform API rate limits, maintenance, or technical issues. We are not liable for any decisions made based on delayed or missing data.
7. Acceptable Use
You agree not to:
- Attempt to circumvent platform API rate limits through Viewpulse
- Use Viewpulse to monitor accounts you do not own or have permission to access
- Attempt to reverse-engineer, decompile, or hack the Viewpulse service
- Use Viewpulse for any unlawful purpose
8. Intellectual Property
The Viewpulse service, including its design, code, and branding, is owned by Vector Mesa LLC. Your analytics data belongs to you. Platform content and trademarks (YouTube, Instagram, TikTok) belong to their respective owners.
9. Termination
You may terminate your account at any time by contacting hello@useviewpulse.com. We reserve the right to suspend or terminate accounts that violate these Terms.
10. Limitation of Liability
Viewpulse is provided “as is” without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the service. Our maximum liability to you shall not exceed the amount you have paid for the service in the past 12 months.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes via email. Continued use of Viewpulse after changes constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of the jurisdiction where Vector Mesa LLC is incorporated, without regard to conflict of law principles.
